Well, ... if you were to find another example from the same artist where that image was clearly used,... you might get an idea that there was a pattern developing…
Again, not trying to stir isht up – but it seems pretty clear. . . .and it sucks to see if it’s true.

I saw a lot of T-shirt of the day at DBH from the collage images obtained from search engines like google … question, why now its a problem? anything because we’re from Indonesia? In Indonesia have rights Reserved. but because the Internet and technological advances copyrights become confusing? it is easy to just take pictures on the internet and turn on advanced Photoshop is something new shape.

@McFlyHigh: yeah I admit that was my mistake..but what about EarlyBird design by earlyblack..If you all notice the bird silhouette its kinda the same like jktskrg design
and what I regret to DBH community is because you are all questioning the design after the design in print, not during the voting period on the design. If these design have a problems, you should be disputed at the voting period not when the design has been print. That’s why we have voting session and that is the vote session function.

Designs should be disputed whenever a discrepancy is noticed, whether it’s in the voting stage or already printed. It would’ve been nice if someone noticed before it was printed, but obviously nobody did.

@thestray: yea I agree that design should be disputed whenever discrepancy is noticed, but isn’t that strange that nobody didn’t notice this design have a problem back when this still on voting stage. I mean, every design have a lifespan for 120 days in voting stage right?(correct me if I’m wrong) and for 120 days everybody can see and vote and comment the design, but why during this long long 120 days somebody didn’t notice whether the design violated DBH terms or not? And then when this design being sold on DBH, suddenly in a few days somebody recognize that this design violated the terms…that’s kinda strange to me..

I could only give a suggestion to DBH that, I think DBH should check twice or thrice before they picked a winner whether the winners violated your terms or not.

and to all DBH members, please be more selective when you vote a design and if you find anything wrong on the design i.e: copyright issue or else, please spill it when it’s still on voting stage. Because that will also help DBH to pick the best design..

No, I don’t find that strange at all, because it only takes one person to notice, and there’s no guarantee that the one person to notice will see it during that 120 days. And another point, these designs aren’t being looked at every day that they’re up, we all know the longer they’re up the most pushed back they go into the design pages and the less people see them. After a few weeks they’re buried 10, 20, or 30 pages back and nobody’s looking at it. So it’s very easy for something to go unnoticed. So again, no I don’t really find it strange at all.

What do you expect DBH to do in order to check if a submission has violated terms? They can’t look at every image on the internet. How can they check twice or thrice if there’s no reliable way to check if a work is stolen even a first time? So they really have no choice other than to just trust that people are being honest. And in this case, a skull, skulls are so common that it’s no wonder that it went unnoticed for so long.

As far as DBH members being more selective, I don’t think there’s an issue there, people do spill it when it’s in the voting stage when they spot it. DBH members aren’t being negligent. Nobody here seems to have a problem speaking up when they see something wrong.

The only issue is with the people who submit stuff that violate the terms. Sometimes it’s malicious, but I think more often then not it just comes from people not understanding what is and isn’t fair use. So I encourage anyone who’s submitting artwork to really do their research and homework about copyright and fair use.

ah…that’s my bad…you’re right thestray…but sometimes people like to exaggerate on copyright issues..even God creates similarities like this
